These Terms of Use ("Terms") govern your access to and use of the ScoutBall AI platform and services provided by ScoutBall AI, Inc. ("ScoutBall AI," "we," "our," or "us"), including any web or mobile applications, tools, dashboards, content, and other features (collectively, the "Services").
By accessing or using the Services, creating an account, or submitting content, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Services Overview ScoutBall AI provides a platform for youth baseball coaches, teams, and organizations to evaluate players, manage tryouts, track performance, and build rosters using data-driven tools. If you use the Services on behalf of an organization, you affirm that you are authorized to bind that organization to these Terms.
2. User Accounts
- Account Types: Includes Registered Users, Team Admins, and Guests.
- Account Responsibilities: Users must provide accurate information and maintain security over their login credentials.
- Children’s Data and Parental Consent: The Services are not directed to children under 13, and users must be at least 13 years old to create an account. Player Data and Media Content for minors under 13 may be provided only by a parent or legal guardian, or by a Team Admin or Organization with verified parental consent, in accordance with applicable law and the Children’s Online Privacy Protection Act (COPPA). By providing such information, you consent to its use under our Terms and Privacy Policy. Parents or guardians may request access to or deletion of their child’s data by contacting info@scoutball.com.
3. User Content and Licenses You retain ownership of all content you submit ("User Content"), and grant us a non-exclusive, royalty-free, global license to use it for purposes such as operating and improving the Services, research, and marketing. You represent that your content complies with applicable laws and that you have necessary rights and consents.
4. Acceptable Use You agree not to:
- Use the Services unlawfully
- Post offensive or infringing content
- Reverse engineer, scrape, or automate interactions with the Services
- Share your account or credentials
5. Paid Services
- Fees: All payments are in USD and may include subscriptions or one-time purchases.
- Renewals: Subscriptions renew automatically unless cancelled.
- Refunds: All purchases are non-refundable except where required by law.
6. Intellectual Property ScoutBall AI owns all platform content and software, excluding User Content. You may not use ScoutBall AI trademarks or intellectual property without written permission.
7. Third-Party Services ScoutBall AI may link to or integrate third-party tools and websites. We are not responsible for their content or practices.
8. Termination We may suspend or terminate your access to the Services for any violation of these Terms.
9. Disclaimer of Warranties The Services are provided "as is." We disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
10. Limitation of Liability ScoutBall AI is not liable for indirect, incidental, special, or consequential damages. Our total liability will not exceed the amount paid by you in the past 12 months.
11. Dispute Resolution and Arbitration
- Governing Law: Florida law governs these Terms.
- Arbitration: Any disputes will be resolved through binding arbitration in Pinellas County, Florida.
- Class Action Waiver: You waive the right to participate in any class action.
- Opt-Out: You may opt out of arbitration by emailing info@scoutball.com within 30 days.
12. General Provisions
- Entire agreement between you and ScoutBall AI.
- Severability: Invalid provisions do not affect the rest.
- No waiver unless in writing.
